01Purpose
These Terms of Service govern the conditions, rights, and obligations for using the website, free trial, and paid software licenses provided by Florix.
02Definitions
- "Florix" means the Windows automatic project backup software and its related website.
- "User" means any individual or organization that visits the Florix website or uses the free trial or a paid license.
- "License" means the right to install and use the Florix software within the scope set out in these Terms.
03Service Offerings
Florix provides features necessary for project backup, including automatic backup of working folders, exclusion of cache and temp files, backup to external drives, NAS, and SMB storage, point-in-time restore, and backup verification.
The features offered, supported operating systems, and pricing may change as the product develops and operations evolve. Material changes will be communicated through the website or by email.
04Payments and License Issuance
- Payments for paid licenses are processed by Polar Software Inc. as the Merchant of Record (the seller of record). Your purchase, applicable taxes, invoicing, and payment-related refunds are handled by Polar. Prices are charged in US dollars (USD).
- Once payment is complete, a license key is issued to the email address provided by the user. The amount billed in your local currency may vary depending on your card issuer's exchange rate.
- Detailed conditions for use of the software are governed by the End User License Agreement (EULA) accepted at installation.
05Free Trial and Paid License
- Florix may provide a 14-day free trial so you can evaluate the product before purchasing. The trial is available once per PC.
- A paid license is intended for use on one (1) PC unless otherwise indicated.
- A license grants the user the right to use the software; it does not transfer ownership or any intellectual property rights in the software.
- License keys, installation files, and account credentials must be kept secure by the user and may not be transferred, loaned, or shared with third parties.
06User Responsibilities
Before using Florix, users must keep copies of important files in a separate location and independently verify backup results and restorability.
07Prohibited Activities
- Unauthorized distribution, sharing, or sale of license keys or installation files
- Reverse engineering, unauthorized modification, or circumvention of security features of the software
- Use that infringes the rights or systems of others
- Acts that disrupt service operations or generate abnormal traffic
- Any activity that violates applicable laws or these Terms
08Intellectual Property
All rights to the Florix name, logo, website design, software, documentation, images, code, and other content belong to Florix or the respective rights holders.
Users may not reproduce, distribute, modify, create derivative works from, or commercially exploit these without the prior written consent of Florix.
09Refunds and Right of Withdrawal
- Even after a license key has been issued, if the user has not activated the key or used any paid features, the user may request withdrawal of purchase within 7 days of the payment date.
- If the user has activated the license key or begun using paid features, access to the digital content is deemed to have commenced and the right of withdrawal may be limited. However, any consumer rights recognized under applicable law are not restricted.
- In cases of duplicate charges, non-issuance of a license key, or material product defects attributable to Florix, a refund or replacement will be provided. Refund processing may be handled through the payment processor (Polar).
Florix does not restrict the consumer rights established by relevant laws, including the Act on the Consumer Protection in Electronic Commerce, Etc. (Republic of Korea).
10Changes to These Terms
Florix may amend these Terms in response to changes in applicable laws, service operations, or product policy. Changes will be posted on the website, and material changes may be communicated through additional reasonable means.
11Governing Law and Dispute Resolution
These Terms and your use of Florix are governed by and construed in accordance with the laws of the Republic of Korea. In the event of a dispute arising from use of the service, the Seoul Central District Court shall have jurisdiction as the court of first instance, to the extent permitted by applicable law.
Language. Florix is a business established in the Republic of Korea. This English text is provided for convenience only; if there is any conflict between this English version and the Korean version, the Korean version prevails.
